Terms of Service
Welcome to Customer Data Cleaner ("CDC"), a product by Gradient Information Systems Pty Ltd based in Melbourne, Australia. These Terms of Service ("Terms") govern your access to and use of our trial service, including our website, data cleaning tools, and related services (collectively, the "Service").
1. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Trial Service Description
CDC offers a free demo service that allows users to upload data files for analysis, duplicate detection, and data quality improvement. The trial is intended for evaluation purposes only.
3. User Responsibilities
When using our Service, you agree to:
- Submit only test or anonymised data without any sensitive or personally identifiable information (PII)
- Not use the Service for any illegal purpose or in violation of any local, state, national, or international law
- Not attempt to gain unauthorised access to any portion of the Service or any other systems connected to the Service
- Not use the Service to transmit any viruses, malware, or other malicious code
4. Data Usage and Privacy
4.1 Data Ownership
You retain all ownership rights to your data. We do not claim any ownership rights to the data you submit.
4.2 Data Usage
Data submitted to our trial Service will be:
- Used solely for the purpose of demonstrating our data cleaning capabilities
- Processed and analysed to identify potential duplicates and data quality issues
- Stored temporarily to provide you with results and demonstrate functionality
4.3 Data Retention
Data submitted to our trial Service, including the submitted file and the corresponding results file, will be stored for 7 days after processing. After this 7-day period, all submitted data and result files will be automatically and permanently deleted from our systems. Results files will be available for download via the link provided in the email during this 7-day period only.
5. Intellectual Property
All intellectual property rights in the Service and its content, features, and functionality are owned by Gradient Information Systems Pty Ltd. These Terms do not grant you any rights to use our intellectual property.
6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will function uninterrupted, secure, or available at any particular time
- The results that may be obtained from the use of the Service will be accurate or reliable
- Any errors in the Service will be corrected
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRADIENT INFORMATION SYSTEMS PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
8. Indemnification
You agree to indemnify and hold Gradient Information Systems Pty Ltd and its affiliates, officers, agents, employees, and partners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of these Terms. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts located in Melbourne, Victoria.
11. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
12. Entire Agreement
These Terms constitute the entire agreement between you and Gradient Information Systems Pty Ltd regarding our Service and supersede all prior agreements and understandings.
